The Hamburg/Sharfstein-led U.S. Food and Drug Administration (FDA) is substantially re-energizing FDA enforcement and Congress is pushing them hard, which only puts a strong wind at their backs. Warning letters are up substantially. The Commissioner has told Senator Grassley that she intends to have the FDA increase its use of misdemeanor (non-intent) criminal prosecutions against individuals in positions of corporate responsibility. And imported products are facing ever more scrutiny - limited only by FDA resource constraints. What does all of this mean for manufacturers of cosmetics and cosmetic-drugs?
